This privacy policy (“Privacy Policy”) describes the privacy practices of Screenvision Direct, Inc. and Screenvision Exhibition, Inc. (collectively “Screenvision,” “we,” “us,” or “our”) with regard to our use and disclosure of the information that we and third parties authorized by us collect about visitors to the Screenvision website ( (the “Site”), those who bring their mobile devices to movie theaters and sports venue locations in Screenvision’s network (“Venues”), and users of our applications. This Privacy Policy also applies to those who interact with the services we provide, which include mobile and digital advertising, advertising in and around Venues, any software development kits (“SDKs”) that we provide to our advertising network (“Exhibitors”), Venues and/or advertisers (“Brands”) for incorporation into their applications, information and advertising delivered on screens located in and around Venues, and interactive services such as “text to screen” that we may provide at Venues or elsewhere. Collectively, the Site and our services are the “Services”. You can learn more about our Services here.


We collect information in multiple ways, including when you provide information directly to us; when we passively collect information from or about you, such as from your browser or device; and from third parties. We may combine all of the information we collect from or about you from these various sources.

Information You Provide Directly to Us. We will collect any information that you provide to us.

For example, if you contact us, including via our MovieBot chat, when you sign an insertion order, and when you fill out our “contact us” form online, we may collect certain information, 2 such as your name, email address, company name, phone number, location, and the contents of any message you send; if you attend a movie or sports event at one of our Venues, or participate in an event or activity, we may collect information such as your email address.

You can choose not to provide such information, but, in general, most of the information we request from you is required for us to provide the Services and the lack of such information will prevent us from doing so. We will collect, use, transfer and disclose this Information as described in this Privacy Policy.

Information that Is Automatically Collected. We also collect information through automated and technical means as you browse our Sites, use our Apps, attend movies and/or sporting events at Venues, or otherwise use the Services.

  • Device and Online Usage Information. We and our service providers may automatically collect certain information about the computer(s) or device(s) (including mobile devices and/or tablets) you use to access the Services and/or bring to Venues. As described further below, we may collect and analyze information such as (a) IP addresses, precise location information derived from an IP address, GPS, geo-location unique device identifiers, IMEI and TCP/IP address, and other information about your computer and device(s), browser types, browser language, operating system, mobile device carrier information, the state or country from which you accessed the Services and or visited Venues; and (b) information related to the ways in which you interact with the Services, such as: referring and exit web pages and URLs, platform type, the number of clicks, domain names, landing pages, pages and content viewed and the order of those pages, statistical information about the use of the Services, the amount of time spent on particular pages, the date and time you used the Services, the frequency of your use of the Services, error logs, and other similar information. As described further below, we may use third-party analytics providers and technologies, including cookies, UTM parameters, and similar tools, to assist in collecting this information.

  • Cookies and Other Tracking TechnologiesWe and our service providers may also collect data about your use of the Services and/or attendance at Venues through the use of Internet server logs and online tracking technologies, like cookiesUTM parameters, and/or tracking pixels. A web server log is a file where website activity is stored. A cookie is a small text file that is placed on your computer when you visit a website, that enables us to: (a) recognize your computer; (b) understand the web pages of the Services and other webpages you have visited; (c) enhance your user experience by delivering content and advertisements specific to your inferred interests; (d) perform searches and analytics; and (e) assist with security administrative functions. Tracking pixels (sometimes referred to as web beacons or clear GIFs) are tiny electronic tags with a unique identifier embedded in websites, online ads and/or email, and that are designed to provide usage information like ad impressions or clicks, measure popularity of the Services and associated advertising, and to access user cookies. We and our Exhibitors, Brands, Venues, and/or service providers may also include Web beacons in email messages, newsletters and other electronic communications to determine whether the message has been opened and for other analytics, personalization and advertising. As we and our service providers adopt additional technologies, we may also gatheradditional information through other methods. Please note that you can change your settings to notify you when a cookie is being set or updated, or to block cookies altogether.   • Analytics Information. We and our service providers (such as those of Google Analytics, and Drift) may also collect analytics data through our Services to collect and analyze the information discussed above and to engage in auditing, research, and/or reporting. The information (including your IP address) collected by various analytics technologies described in the “Cookies and Other Tracking Technologies” section above will be disclosed to or collected directly by these service providers, who use the information to evaluate your use of the Services, including by noting the third-party website from which you arrive to our Sites and/or Exhibitor, Venue and Brand sites, analyzing usage trends, assisting with fraud prevention, and providing certain features to you. Information We Collect from Third Party Sources. We may also collect information about you or others through non‐affiliated third parties, including from our Exhibitors, Brands and Venues, and marketing and market research firms. For example, depending on the particular relationship, we may get information from Exhibitors about your movie‐going, attendance at sporting events and concession purchasing habits or your membership in an Exhibitor’s loyalty program. In addition, we may get information from third parties, such as device identifiers and interests. We may obtain audio information collected in Venues but it is not recorded or stored by us. We may also get demographic information from market research firms data aggregators, data providers, and third‐party data services such as race, color, sex/gender, religious and philosophical beliefs, gender identity/expression/sexual orientation, marital status, military or veteran status, nationality, ancestry, ethnicity, language use and political opinions. We may combine information that we collect from or about you through the Services with information that we obtain from such third parties.


We may use the information we collect from and about you for the following purposes:

  • For the purposes for which you provided it;
  • To provide and improve the Services, including to develop new features or services, to provide you with tailored content, and for technical and customer support;
  • To enable Exhibitors, Venues and Brands to provide and improve their services, including to develop new features or services and provide you with tailored content;
  • To send you information or other communications, such as newsletters;
  • For marketing and advertising purposes, including to contact you with information or surveys that we believe may be of interest to you regarding our products and Services and those of Brands, ExhibitorsVenues, and other third parties, and to serve ads on the Services and third-party sites;
  • To identify you by your device(s) and to match your device(s) across our Services and our Exhibitors’, Venues’ and Brands’ services, including to match your interests across devices and for analytics, ad serving, and/or reporting;
  • To process and respond to your inquiries or to request your feedback;
  • For internal analytics, research, and reporting;
  • To comply with the law and protect the safety, rights, property, or security of Screenvision, the Services, our Brands, Exhibitors, Venues, customers, and the general public; and
  • To enforce the legal terms that govern your use of the Services.


Please note that we may combine information that we collect from or about you (including automatically collected information) with information we obtain about you from our affiliates and/or non‐affiliated third parties, and use such combined information in accordance with this Privacy Policy.

We may aggregate and/or de‐identify information collected through the Services. We may use de‐identified and/or aggregated data for any purpose, including without limitation for research and marketing purposes, and may also share such data with any third parties, including Exhibitors, Venues, Brands, and/or others.


We may disclose and/or share your information under the following circumstances:

  • Exhibitors, Venues and Brands. We disclose some information about you, aggregated with others information, to our Exhibitors, Venues, and Brands to help them better understand moviegoers and sports fans, and develop and tailor advertising and promotions accordingly. Our Exhibitors, Venues, and Brands may use your information for their own direct marketing purposes.
  • Service Providers. We disclose your information to third parties who perform services on our behalf, including without limitation, data storage, data analysis and processing, marketing, market research collections, and legal services.
  • Legal Compliance and Protection of Screenvision and Others. We may disclose your information if required to do so by law or on a good faith belief that such disclosure is permitted by this Privacy Policy or reasonably necessary or appropriate for any of the following reasons: (a) to comply with legal process; (b) to enforce this Privacy Policy, or other contracts with you, including investigation of potential violations thereof; (c) to respond to claims that any content violates the rights of third parties; (d) to respond to your requests for customer service; and/or (e) to protect the rights, property, or personal safety of Screenvision, our agents and affiliates, our Exhibitors, Venues, Brands, and/or the public. This includes exchanging information with other companies and organizations for fraud protection, and spam/malware prevention, and similar purposes.
  • Business Transfers. As we continue to develop our business, we may buy, merge, or partner with other companies. In such transactions (including in contemplation of such transactions, e.g., due diligence), your information may be disclosed. If any of Screenvision’s assets are sold or transferred, customer information (including your email address) would likely be one of the transferred business assets.
  • Affiliated Companies. We may disclose your information to current or future affiliated companies.
  • Other Unaffiliated Third Parties. We may disclose your information to unaffiliated third parties other than those described above, including for those third parties’ own advertising and marketing activities, in accordance with applicable legal requirements.
  • Consent. We may disclose your information to any third parties based on your consent to do so.


The Services may integrate third-party advertising technologies that allow for the delivery of relevant content and advertising on our Services or third-party services you use. The ads may be based on various factors, such as the content of the page you are visiting, your searches, demographic data, and other information we collect from or about you. These ads may be tailored to you based on your current activity or your activity over time and across our Services and other third-party services. We allow third parties to serve tailored ads to you through our Services and other sites and applications, and to access their own cookies or other tracking technologies on your computer, mobile phone, or other device you brought to a Venue and/or you use to access the Services.

We neither have access to, nor does this Privacy Policy govern, the use of cookies or other tracking technologies that may be placed on your device to access the Services by non-affiliated third parties. If you are interested in more information about tailored advertising and how you can generally control cookies from being put on your computer to deliver tailored advertising, you may visit the Network Advertising Initiative’s Consumer Opt-Out link, the Digital Advertising Alliance’s Consumer Opt-Out link, or Your Online Choices to opt out of receiving tailored advertising from companies that participate in those programs. We do not control these opt-out links or whether any particular company chooses to participate in these opt-out programs. We are not responsible for any choices you make using these mechanisms or the continued availability or accuracy of these mechanisms.

Please note that even if you exercise the opt-out choices above, you may continue to receive advertisements, for example, based on the particular website that you are viewing (i.e., contextuallybased ads). Also, if your browsers are configured to reject cookies when you optout on the DAA or NAI websites, your opt out may not be effective.


Do Not Track (“DNT”) is a privacy preference that you can set in certain web browsers. We do not recognize or respond to browser-initiated DNT signals, as the Internet industry is currently still working toward defining exactly what DNT means, what it means to comply with DNT, and a common approach to responding to DNT. We take reasonable administrative, technical, and physical security measures to protect against the loss, misuse, and/or alteration of your information. These safeguards vary based on the sensitivity of the information that we collect and store. However, we cannot and do not guarantee that these measures will prevent every unauthorized attempt to access, use, or disclose your information since despite our efforts, no Internet and/or other electronic transmissions can be completely secure.


We will hold your information for as long as necessary to fulfill the purposes set forth in this Privacy Policy or as long as we are legally required or permitted to do so. Information may persist in copies made for backup and business continuity purposes for additional time.


The Services may contain links to or “frame” third-party websites, applications, and other services. Please be aware that we are not responsible for the privacy practices of such other sites and services. If you are a California resident, California law requires us to provide you with some additional information regarding how we collect, use, and share your “personal information” (as defined in the California Consumer Privacy Act (“CCPA”)).

Categories of personal information we collect, use and disclose. Throughout this Privacy Policy, we discuss in detail the specific pieces of information we collect from and about users and discuss how we use and share such information. The following are the “categories” of personal information under the CCPA that we collect and that we may, as discussed throughout this Privacy Policy, use and disclose for our business purposes.

We may collect, use, and disclose for business purposes, the following categories of information about you or your use of the Services: Identifiers (such as name, address, phone number, device identifiers, and email address); commercial information (such as transaction data); financial data (such as credit card information); internet or other network or device activity (such as browsing history or app usage); general and precise geolocation data; data from which we make inferences about your interests and preferences; audio or visual information or recordings; physical characteristics or description (e.g., if you voluntarily submit a photo) and other information that identifies or can be reasonably associated with you.

California Data Access and Deletion Rights

CCPA RightsCalifornia residents can make certain requests about their personal information under the CCPA. Specifically, if you are a California resident, you may request that we:

  • provide you with information about: the categories of personal information we collect, disclose or sell about you; the categories of sources of such information; the business or commercial purpose for collecting or selling your personal information; and the categories of third parties with whom we share personal information.   • delete certain information we have about you; and/or
  • provide you with information about the financial incentives that we offer to you, if any.


VerificationWe will take reasonable steps to verify your identity before responding to a request, which may include, at a minimum, depending on the sensitivity of the information you are requesting and the type of request you are making, verifying your name, email address, and phone number.

You are also permitted to designate an authorized agent to submit certain requests on your behalf. In order for an authorized agent to be verified, you must provide the authorized agent with signed, written permission to make such requests or a power of attorney. Notice of the Right to Opt Out of the Sale of Information

The CCPA sets forth certain obligations for businesses that “sell” personal information. Pursuant to the definition of sell under the CCPA and current guidance, we believe we engage in such activity and have engaged in such activity in the past twelve months.

The CCPA further provides you with the right to not be discriminated against (as provided for in applicable law) for exercising your rights. Please note that certain information may be exempt from such requests under California law. If you ask us to delete your data, you may no longer be able to access or use the Services.

Shine the Light DisclosureThe California “Shine the Light” law gives residents of California the right under certain circumstances to request information from us regarding the manner in which we share certain categories of personal information (as defined in the Shine the Light law) with third parties for their direct marketing purposes. We share your personal information with third parties for their own direct marketing purposes.


Under Nevada law, certain Nevada consumers may opt out of the sale of “personally identifiable information” for monetary consideration (as such terms are defined under Nevada law) to a person for that person to license or sell such information to additional persons. We do not engage in such activity; however, if you are a Nevada resident and you have purchased Services from us, you may submit a request to opt out of any potential future sales under Nevada law by Please note we may take reasonable steps to verify your identity and the authenticity of the request. The Services are intended for general audiences and not for children under the age of 13. If we become aware that we have collected “personal information” (as defined by the United States Children’s Online Privacy Protection Act) from children under the age of 13 without legally-valid parental consent, we will take reasonable steps to delete it as soon as possible. We also comply with other age restrictions and requirements in accordance with applicable local laws.
